Equipment rental agreement

By accepting this agreement on the rental form (in the shop or online), you (the “responsible person”) enter into this agreement for yourself and for every person listed on the form (“the group”).
1. WHO THIS COVERS
1.1 You confirm that you are at least 18 years old and that you are authorised to accept this agreement for everyone in the group. For children in the group, you confirm that you are their parent or legal guardian, or that their parent or guardian has authorised you.
1.2 You make sure that everyone in the group knows and follows these terms.
2. CORRECT INFORMATION AND BINDING SETTINGS
2.1 The release setting of ski bindings (DIN) is set by our technician from the weight, height, age, skier level and boot size you give us, following the ISO 11088 standard. Wrong information can lead to a binding that releases too early or too late, and to serious injury.
2.2 You confirm that the information you give for each person is true and complete. Tell the desk straight away if anything changes, if someone skis at a different level than stated, or if the equipment passes to another person.
2.3 Do not adjust the bindings yourself and do not let anyone else do so. Bring the equipment back to the shop for any adjustment – it is free.
3. HANDOVER AND CONDITION
3.1 You receive the equipment in good working order. Check it, and the fit of the boots and helmets, before you leave the shop, and tell us straight away about anything that is wrong. If a problem appears on the slope, stop using the equipment and bring it back; we will fix or replace it.
3.2 The equipment may only be used by the person it was set up for, only for skiing or snowboarding on marked pistes and in normal conditions, and it may not be lent or sublet to anyone else.
4. RISKS ON THE MOUNTAIN
4.1 Skiing and snowboarding carry a risk of injury, including serious injury, even with correctly set and well-maintained equipment. Correctly set bindings reduce this risk but cannot remove it.
4.2 You accept these risks for yourself and, as far as the law allows, for the group. You agree to follow the FIS rules of conduct and the rules of the ski area, to ski within your ability, and to respect signs and closures.
4.3 We strongly recommend a helmet for everyone, and for children in particular.
5. OUR RESPONSIBILITY
5.1 We are responsible for giving you equipment that is safe, maintained and set according to the information you gave us.
5.2 We are not responsible for injury, loss or damage caused by: wrong or incomplete information given to us; adjustments made by anyone other than our staff; use by a person other than the one the equipment was set up for; use contrary to this agreement or the rules of the ski area; or the ordinary risks of the sport described in section 4.
5.3 Nothing in this agreement limits our liability where Bulgarian law does not allow it to be limited, in particular for damage caused intentionally or by gross negligence, nor any right you have as a consumer.
6. DAMAGE, LOSS AND THEFT
6.1 You are responsible for the equipment from the moment you receive it until it is returned to the shop.
6.2 Normal wear and tear is free. For damage beyond normal wear (for example a broken ski, a deep core shot or a cracked boot shell) you pay the cost of repair, or the replacement value if repair is not possible.
6.3 If equipment is lost or stolen you pay its replacement value. Do not leave equipment unattended: use a ski locker or rack lock. Report a theft to the police and to us on the same day and give us a copy of the police report.
6.4 We will show you the cost before charging it, and we charge it at the current replacement value of that model, never more.
7. RENTAL PERIOD AND RETURN
7.1 The equipment is to be returned by closing time on the last day of the rental.
7.2 You can extend the rental by telling the desk or calling us; the extra days are charged at the price list rate. Equipment not returned on time, without an extension, is charged per extra day at the price list rate.
7.3 Days not used after the rental has started are not refunded. If you need to finish early, tell us: in some cases, for example injury, illness or closed lifts, the shop may at its own discretion offer a refund or a credit for the unused days. Such a gesture in one case does not create a right to it in another.
8. PRICE, PAYMENT AND CANCELLATION
8.1 Prices follow the shop’s price list or the price confirmed with your online booking.
8.2 Payment is made at the desk, when you collect or when you return the equipment, or online when you book – a deposit or the full amount, by card on the secure myPOS payment page. Anything paid online is deducted from the amount due at the shop.
8.3 Cancelling a booking: if you cancel at least 7 days before the first day of the rental or lesson, we refund everything you paid to the card used for payment. Later cancellations and no-shows are not refunded.
8.4 If we or the ski school cancel the booking or part of it (for example, no instructor is available), the affected part is refunded in full. Closed lifts, bad weather and other events outside our control do not give a right to a refund (see also 7.3).
8.5 To cancel, contact us on +359 888 766 736 or at contact@avantgarde-ski.com with your booking code. When a refund shows on your card depends on your bank (usually within 10 working days).
9. YOUR PERSONAL DATA
9.1 We process the names, contact details, age, weight, height, skier level and shoe size given on this form to perform this rental and to set the equipment safely (GDPR art. 6(1)(b)), and we keep what the law requires for accounting.
9.2 If you tick “Remember our details for next time”, we keep the group’s details and equipment sizes so your next visit starts pre-filled (GDPR art. 6(1)(a)). We delete them after five seasons without a visit, or earlier when you ask. Without that consent, the details are removed when the rental is closed, apart from what the law requires us to keep.
9.3 We do not sell your data or use it for advertising. You can ask for access, correction or deletion at the shop, by phone, or by email to contact@avantgarde-ski.com, and you may complain to the Commission for Personal Data Protection (www.cpdp.bg).
10. LAW
10.1 This agreement is governed by Bulgarian law. Your statutory rights as a consumer are not affected.
By accepting, I confirm that I have read and understood this agreement, that the information I have given is correct, and that I accept it for myself and on behalf of everyone in the group.
Ski school lessons
Please be at the meeting point at least 15 minutes before the lesson starts. If you are more than 15 minutes late, the lesson is cancelled and the amount paid is not refunded.
Lessons booked in advance must be confirmed no later than 1 (one) day before the start date, otherwise the lesson may be cancelled.
A lesson is reserved once a deposit of at least 20% of the price has been paid. After booking you will receive a confirmation at the email address you gave us.
Cancellation: if you cancel by email or phone at least 7 days before the lesson starts, we refund everything you paid; later cancellations and no-shows are not refunded. If the school cancels the lesson (for example, no instructor is available), the amount for it is refunded in full.
We do not give refunds for injuries during a lesson, or in cases of force majeure, including partial or full closure of the lifts, bad weather or other events outside our control.
Prices are in euro and include VAT.
